Terms of Service

    1. Acceptance of Terms

    By accessing or using QFLOW (the "Service"), operated by Odysense Technologies W.L.L. ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service. These Terms constitute a legally binding agreement between you and the Company.

    2. Service Description

    QFLOW provides a cloud-based restaurant management platform including, but not limited to: QR code-based digital menus, order management systems, kitchen display systems, point-of-sale (POS) functionality, bill splitting, payment processing integration, analytics dashboards, and table management tools. The specific features available to you depend on your subscription plan.

    3. Account Registration

    To use the Service, you must create an account. You agree to:

    • Provide accurate, current, and complete information during registration
    • Maintain and update your information to keep it accurate
    • Maintain the security of your account credentials and not share them with third parties
    • Accept responsibility for all activities that occur under your account
    • Notify us immediately of any unauthorized access or security breach

    We reserve the right to suspend or terminate accounts that contain inaccurate information or violate these Terms.

    4. Subscription and Payment Terms

    4.1 Pricing

    Paid plans are billed on a recurring basis (monthly or annually) at the rates displayed at the time of purchase. We reserve the right to change pricing with 30 days' written notice.

    4.2 Billing

    Recurring charges are billed automatically to your designated payment method. You are responsible for keeping your payment information current. Failed payments may result in service suspension.

    4.3 Cancellation

    You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused portions of a billing period.

    4.4 Refunds

    Refund requests are handled on a case-by-case basis. Please contact support@qflow.app within 14 days of a charge to request a review.

    5. Payment Processing

    QFLOW integrates with third-party payment processors (including Stripe and Tap) to facilitate customer payments at your restaurant. Transaction fees are determined by the payment processor and are the responsibility of the restaurant owner. We are not liable for payment processing errors, delays, or disputes between you and the payment processor.

    6. Acceptable Use

    You agree not to use the Service to:

    • Violate any applicable law, regulation, or third-party rights
    • Upload content that is illegal, harmful, threatening, defamatory, or obscene
    • Interfere with or disrupt the Service or servers connected to it
    • Attempt to gain unauthorized access to any part of the Service
    • Use the Service for any purpose other than its intended restaurant management functionality
    • Reverse engineer, decompile, or disassemble any part of the Service
    • Use automated tools to scrape, crawl, or extract data from the Service

    7. Intellectual Property

    7.1 Our IP

    The Service, including its software, design, logos, trademarks, and documentation, is owned by Odysense Technologies W.L.L. and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

    7.2 Your Content

    You retain ownership of content you upload to the Service (menus, images, descriptions). By uploading content, you grant us a non-exclusive license to use, display, and distribute that content solely to provide the Service. You represent that you have the right to upload all content and that it does not infringe third-party rights.

    8. Data and Privacy

    Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. You are responsible for ensuring that your use of customer data complies with applicable data protection laws in your jurisdiction.

    9. Service Availability

    We strive to maintain 99.9% uptime but do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will provide reasonable notice for planned maintenance when possible.

    10. Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, QFLOW AND ODYSENSE TECHNOLOGIES W.L.L. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

    11. Indemnification

    You agree to indemnify, defend, and hold harmless Odysense Technologies W.L.L., its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

    12. Termination

    We may suspend or terminate your access to the Service at any time for violation of these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately. You may export your data within 30 days of termination by contacting support. After 30 days, your data may be permanently deleted.

    13. Governing Law and Dispute Resolution

    These Terms shall be governed by and construed in accordance with the laws of the State of Qatar. Any disputes arising from or related to these Terms or the Service shall be resolved through binding arbitration in Doha, Qatar, in accordance with the rules of the Qatar International Court and Dispute Resolution Centre (QICDRC). Each party shall bear its own costs of arbitration.

    14. Modifications

    We reserve the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must discontinue use of the Service.
